Mandatory Elements of a Company Website

2024 Aug 6. | Website

Online presence is becoming an increasingly integral part of our lives – today, virtually no business can avoid participation in the digital space. Websites play a crucial role in achieving success. Most companies, entrepreneurs, and website operators need to be made aware of the elements legally required to be placed on their websites. If I have piqued your interest, read and utilize the following information.

Mandatory Element of a Company Website: The Impressum!

What is an Impressum? The Impressum is part of various printed or online media products that contain the most important data related to it. Its display and mandatory content are determined by law. When creating a website, pay attention to these details, as incomplete information can result in severe penalties. In Hungary, the regulation of electronic commercial services and services related to the information society is governed by Act CVIII of 2001.

Let’s look in detail at what information must be placed on the website:

Name of the Service Provider

It is essential to display the name of the individual operating the website according to their ID, or for companies, the name found in the company register.

Location, Headquarters, or Residential Address

The official headquarters listed in the company register or the place of business must be displayed. For individual entrepreneurs, the address listed on their ID card should be shown.

Contact Information of the Service Provider

The email address regularly used for customer contact must be provided.

Registration Number of the Service Provider, Name of the Court or Authority Registering Them

For companies: the court maintains the company registers.

For social organizations: the county court handles the registration.

Tax Number of the Service Provider

If the service provider is subject to VAT, their tax number must be displayed.

Official License

For regulated professions (the practice of which requires a specific qualification certificate, state exam, or similar exam, or membership in a professional organization), the name of the licensing authority, contact information, and the license number must be displayed. The provider’s qualifications or academic degrees must also be named.

Chamber Membership

If you are a member of a chamber, it is mandatory to display the chamber in the Impressum. For companies, this is the territorially competent chamber of commerce and industry.

Hosting Provider

It is mandatory to display the name, headquarters, and contact information of the website’s hosting provider.

Accessibility

The Impressum must be easily accessible. Place it in a visible, accessible spot. It is not advisable to create a subpage for it that is not linked anywhere on the site, as visitors will not be able to find it. One of the best options is to place a link to the Impressum in the footer, as the footer appears on every subpage.

Other Mandatory elements

Terms and Conditions (T&C)

If you sell any services or products, the details must be specified in the T&C. For example, billing, payment, and delivery terms, warranty and guarantee conditions, the right of withdrawal, and termination conditions must be listed in the T&C.

GDPR (Data Protection Declaration)

The General Data Protection Regulation of the European Union. The service provider must inform visitors about the data collected during their visit to the website and how this information is used, as well as the rights of the data owners.

Cookie Declaration

What are cookies: files that are placed on our computer when we visit a website. These are sent back to the site by the web browser with each visit, allowing the site to know what we have done previously. This helps personalize the website for the visitor. If the site uses cookies, visitors must be informed, certain cookies must be accepted, and for others, it is sufficient to provide information. There are several types of cookies, such as:

  • essential cookies
  • preference cookies
  • statistical cookies.

Consequences of Non-Compliance

The consumer protection authority can initiate proceedings. As a result of the procedure, one can expect a financial penalty. Our WordPress-based company websites comply with all legal regulations.
